Terms and Conditions – HUB 38
1. Subject Matter
1.1 These Terms and Conditions (“Terms and Conditions”) define the rules and conditions for the provision of the services described in Section 2, which HUB 38 Ltd. (hereinafter referred to as “HUB 38”) offers to both individuals and legal entities.
1.2 The Terms and Conditions are binding upon all visitors and users of the Website and/or the provided Services. By using the Website, you confirm that you have read and unconditionally accept them. If you do not agree with any provision herein, please discontinue use of the Website and refrain from requesting Services through it or by any other means.
1.3 HUB 38 provides individual workspaces (“offices”) for shared use, as well as additional services related to the use of these spaces. For the purposes of these Terms and Conditions, “shared-use workspace” refers to a space in which one or more tenants (“Clients”) may rent an office or workstation on an hourly, daily, weekly, or monthly basis. Workstations and offices may only be used for activities characteristic of an office environment, unless otherwise specified in the Client’s individual contract (“Lease Agreement”).
1.4 The workspace operates under the name HUB 38 and is located at:
Sofia, 38 Ivan Vazov St., Floor 2, Apartment 4.
2. Types of Services Provided
HUB 38 provides the following services:
2.1 Rental of individual shared office spaces and workstations in a shared space.
Each office provides access to WiFi internet, lounge seating and a coffee table, a whiteboard, and 3 workstations equipped with ergonomic desks and chairs. Each tenant has access to restrooms, lighting, electricity supply, central heating, a waiting area for clients and visitors, a kitchenette, and a terrace.
Reservation time changes for rented offices or workstations may be made up to 2 hours in advance. Cancellations may be made up to 24 hours in advance.
2.1.1 Hourly rental of individual offices and workstations
Includes use of WiFi internet, central heating, complimentary tea and water, and an online reservation system.
Each rental period is 60 minutes, with an additional 15-minute in total buffer time before and after the reserved time, free of charge. For multi-hour reservations, buffer time applies before the start and after the end of the entire booked period.
Office rental price of individual office: 35.20 BGN/hour (18 EUR/hour)
Workstation rental price in a shared space: 15.65 BGN/hour (8 EUR/hour)
2.1.2 Rental of individual offices in packages (“Packages”)
All packages are valid for 1 month from the activation date selected by the Client.
Each package includes: individual access to offices via a mobile app (virtual key), access to the online booking system, WiFi internet, central heating, complimentary tea and filtered water.
For a 60-minute office reservation, a total of 15 minutes of buffer time is provided before and after the reserved hour. For multiple-hour reservations, the buffer applies before the start and after the end of the rental period.
2.2 Package Plans Offered by HUB 38
2.2.2 Package LIGHT – 1-month validity, includes 10 office hours, 293.37 BGN (150 EUR), 29.34 BGN (15 EUR/hour), 20% Discount on event room rental.
2.2.3 Package STANDARD – 1-month validity, includes 30 hours, 733 BGN (375 EUR), 24.45 BGN/hour (12.50 EUR/hour), 20% Discount on event room rental, includes rollover of up to 5 hours to the next month (must be requested via email).
2.2.4 Package MAX – 60 hours, 1173.50 BGN (600 EUR), 19.55 BGN/hour (10 EUR/hour), 20% Discount on event room rental, rollover of up to 10 hours to the next month (must be requested via email).
2.3 Rental of event/meeting room suitable for groups of up to 12 people.
Rates:
• 78.23 BGN/hour (40 EUR/hour) for the first two hours
• 58.67 BGN/hour (30 EUR/hour) for three hours or more
Includes WiFi, whiteboard, seating, restrooms, lighting, power outlets, central heating, a waiting area, kitchenette, and terrace.
A 30-minute buffer is provided before and after reservations.
Reservation changes are allowed up to 2 hours in advance (depending on availability).
Cancellations: up to 24 hours in advance.
2.4 Additional Services
2.4.1 Rental of equipment for use only within HUB 38
• HD Projector: 15.65 BGN/hour (8 EUR/hour)
• Flipchart (20 sheets + markers): 19.56 BGN (10 EUR) per event
• Printing:
– Black & white: 0.49 BGN (0.25 EUR) per page
– Color: 1.96 BGN (1 EUR) per page
• Professional event photographer (rates determined by separate agreement)
2.4.2 Catering assistance
Rates for catering arrangements are determined by separate agreement.
Any services not listed herein require additional negotiation and are provided only after a separate agreement/contract is signed.
3. Payment Terms
3.1 Payments for office rentals under Section 2.1 may be made on site in cash or by POS terminal, or via bank transfer (Account Holder: “HUB 38 EOOD”, BIC: FINVBGSF, IBAN: BG02FINV91501017903249) following phone reservation. For phone reservations exceeding 2 hours, a deposit equal to 1 hour of the rental price is required.
3.2 Payments for packages under Section 2.1 may be made on site (cash/POS) or by bank transfer after confirmation by phone from HUB 38.
4. Conclusion of Contract
4.1 HUB 38 may enter into long-term lease agreements.
4.2 These General Terms and Conditions are considered an integral part of the Contract and by signing it, the Client declares that he has read them and accepts them in full. The Contract is effective from the moment of its signing by both parties.
4.3 The Client may specify the date on which they will occupy the office space and define the start date of the lease.
4.4 The Client declares that the information provided by him for the purposes of signing the Contract and completing the standard form is complete, true and accurate.
4.5 The Client is required to provide all data contained in the standard form of the Contract, to confirm the integrity, truthfulness and accuracy of this data, as well as to confirm his agreement with the Contract, these General Terms and Conditions and the Internal Rules.
4.6 A deposit may be required for certain events or long-term leases.
5. Internal Rules
5.1 The Client shall use the premises with the care of a good owner, in accordance with good morals, good neighborly relations, fire safety, sanitary and other applicable rules and regulations, and shall return the premises in good condition upon expiry of the rental period, removing all traces of use.
5.2 The Client shall inspect the workplace prior to use. By commencing the use of the workplace, the Client declares that they accept it as being of adequate quality and in compliance with the conditions of the Agreement.
5.3 The Client shall not disturb the peace, work, or rights of other tenants and owners within the HUB 38 premises, nor those of other occupants of the building.
5.4 The Client shall promptly take all necessary measures to address and remove any damages caused within the premises as a result of the actions—whether intentional or unintentional—of the Client and/or of third parties permitted by the Client to access the premises and shall immediately notify HUB 38 thereof.
5.5 HUB 38 provides Clients with equipment (whiteboard, projector screen, projector, HDMI cables, desk power strips, etc.) and other fully functional furnishings. The equipment is maintained in proper working order, and the Client must use it strictly in accordance with its intended purpose. Any damage resulting from improper use is at the expense of the Client.
5.6 The Client may not carry out any alterations—temporary or permanent—to the rented premises without the prior written approval of HUB 38 and subject to compliance with all applicable regulatory requirements. All permanent improvements made by the Client shall become part of the premises at the moment they are made and shall transfer to the ownership of HUB 38 without any compensation or remuneration payable to the Client.
5.7 The premises rented by the Client may be used exclusively within the hours reserved in advance, unless otherwise agreed in writing.
5.8 Clients are responsible for safeguarding their personal belongings during their stay in the workspace and shall take appropriate measures to ensure their protection.
5.9 The Client shall not use the shared office space for:
• Storage or distribution of hazardous or illegal goods and services;
• Activities generating noise or disturbances that interfere with other visitors;
• Illegal activities of any nature;
• Using the provided address as a “postal address” or “mailbox service” for illegal activities, for receiving hazardous or prohibited items, or items whose import, export, or transport is subject to special notification or authorization requirements, as well as large parcels.
5.10 HUB 38 reserves the right to carry out repairs, renovations, or structural modifications necessary for the maintenance and safety of the building, as well as to remove any arising defects. In the event of imminent danger, the Client shall immediately cease work, vacate the premises, and evacuate if necessary.
5.11 The Client shall comply with all applicable laws and regulatory requirements related to the dissemination of information. The Client bears full responsibility for their actions, including when using internet access through HUB 38’s network.
5.12 Smoking is strictly prohibited in all indoor areas of HUB 38, including the enclosed terrace.
5.13 Subletting, sublicensing, or transferring the offices, access rights, or prepaid packages is not permitted.
6. Access
6.1 Access to the offices is permitted during business hours (07:00–21:00) and varies depending on the rental period selected. The HUB 38 administration operates between 09:00 and 19:00.
6.2 HUB 38 reserves the right to modify its operating hours when necessary. Any changes to operating hours or temporary closure of the premises shall be announced by HUB 38 with reasonable prior notice.
6.3 HUB 38 reserves the right to refuse or immediately terminate the Client’s access to the workspace in cases of violation of the Internal Rules, unethical and/or inappropriate behavior, and/or behavior that disrupts the work of other clients.
6.4 HUB 38 reserves the right to refuse or immediately terminate the Client’s access to the office in cases of violation of Section 5 of the Internal Rules, unethical and/or inappropriate behavior, and/or behavior that interferes with the work of other clients.
6.5 HUB 38 reserves the right to refuse or terminate the Client’s access to the office in cases of non-payment or delayed payment of any amounts due.
7. Liability
7.1 In the event that the Client breaches any provision of the Agreement, these General Terms and Conditions, or the Internal Rules, HUB 38 shall be entitled to immediately suspend or fully revoke the Client’s access to the workspace.
7.2 If the Client breaches any provision of the Agreement, these General Terms and Conditions, or the Internal Rules, resulting in damages to HUB 38, the Client shall be obligated to indemnify HUB 38 for all losses incurred. This includes, but is not limited to, all expenses—legal, administrative, or otherwise—incurred in connection with the protection of the rights and lawful interests of HUB 38. In such cases, HUB 38 shall be entitled to withhold any prepaid rental fees or purchased services as a penalty.
7.3 The Client shall be fully responsible for any individuals granted access to the office by the Client, including ensuring that such individuals comply with the provisions of the Agreement, the General Terms and Conditions, and the Internal Rules.
7.4 The Client shall be liable for any damage caused by the Client, or by the Client’s visitors, guests, or employees, to the rented premises during the rental period. In the event of any such damage, the Client must immediately notify HUB 38. All damages shall be at the Client’s expense and shall be repaired exclusively by HUB 38. The Client shall pay all repair costs within 20 days of the issuance of an invoice and presentation of an assessment of the damage.
7.5 HUB 38 shall not be liable for the content accessed by clients via the internet.
8. Personal Data Protection
8.1 HUB 38 processes and stores personal data of its clients in accordance with the requirements of the Personal Data Protection Act and applicable data protection laws.
8.2 By entering into the Agreement with HUB 38, the Client shall be deemed to have provided informed consent for the submission and processing of their personal data as necessary for the conclusion and performance of the relevant Agreement. The Client expressly consents to their personal data being used to verify their creditworthiness in accordance with the procedures applicable in Bulgaria.
9. Termination of the Agreement
9.1 Agreements for all package plans are fixed term and shall automatically terminate upon the expiration of the period for which they were concluded.
9.2 HUB 38 shall be entitled to unilaterally terminate the Agreement immediately and without notice if the Client breaches any provision of the Agreement, the General Terms and Conditions, or the Internal Rules.
9.3 HUB 38 shall not owe the Client any refund of prepaid amounts, regardless of the grounds for termination.
9.4 On the date of the Agreement termination, the Client shall be obligated to vacate the workspace they have used and return to HUB 38 all keys, access chips, or other means of entry to the premises. If the Client fails to comply, HUB 38 shall be entitled to declare the workspace vacant and remove the Client’s belongings.
10. Final Provisions
10.1 HUB 38 reserves the right to amend these General Terms and Conditions at any time by publishing the updated version on its website.
10.2 HUB 38 shall notify the Client in a timely manner of any amendments. If the Client does not expressly object in writing within 14 days of receiving notice, the Client shall be deemed to have accepted the amended General Terms and Conditions.
10.3 All notifications and documents from the Client to HUB 38 shall be delivered to the address of the shared workspace. Notifications from HUB 38 to the Client shall be considered duly delivered if they are:
• delivered in person;
• sent to the correspondence address provided by the Client; or
• published on the HUB 38 website and/or on the notice board at the shared workspace.
In all such cases, the Client shall be deemed duly notified.
10.4 All disputes between the parties shall be resolved by mutual agreement. In the absence of such agreement, the dispute shall be submitted for resolution to the competent court in Sofia.
